Copyright & Take Down Policy

Copyright Notice and Terms of Use

Materials displayed in Lambda Archives of San Diego's (LASD) online collections may be protected by the U.S. Copyright Law (Title 17, United States Code). Under the law, photocopies or reproductions produced by libraries and archives are not to be "used for any purpose other than private study, scholarship, or research." Any reproduction of items beyond that allowed by fair use requires the written permission of LASD and/or the copyright owners.

Images displayed on the LASD Flickr, Preservica, and other locations are lower-resolution JPG copies provided for academic research purposes only. LASD allows authorized publication of images from its collections for most non-commercial uses, however permission from LASD is required prior to publication or display. Photo credit should read: "Photo courtesy of Lambda Archives of San Diego." Photographic use fees may apply.  Permission from Lambda Archives of San Diego is required for any use of images. To obtain permissions, please fill out the appropriate form and/or contact us at [email protected].

LASD has endeavored to properly identify copyright owners, but there are some images in its collections about which little is known. All responsibility for possible infringement of copyright or other rights is assumed by the user. LASD asks any copyright owners who are not properly identified or for any take-down requests to contact us at [email protected] so that appropriate credit may be given and permissions observed in the future.

Take Down Notice and Policy

Digitized collections are made accessible for purposes of education and research. Lambda Archives of San Diego (LASD) has made efforts to give attribution to rights holders when possible and has taken steps to identify and remediate sensitive information that could threaten the privacy and security of individuals, organizations or other entities represented in the collections.

If you hold the rights to materials in our digitized collections that are unattributed, please let us know so that we may maintain accurate information about these materials. If you are a rights holder and are concerned that you have found material on LASD sites for which you have not granted permission (or is not covered by a copyright exception under U.S. copyright laws), you may request the removal of the material by submitting a notice, with the elements described below, to [email protected].

If sensitive or private information has inadvertently been included in digital collections, living individuals whose private information is exposed (or who are acting on behalf of a minor child or an incapacitated parent, spouse, domestic partner or adult child) are welcome to submit a take-down request. All such requests will be reviewed by relevant LASD stakeholders, who may ask for additional information to better understand the issue and its consequences.

Please include the following in your notice:
  • Identification of the material and information to permit us to locate the material, including collection name and URL.
  • Your contact information, including name, address, telephone number, and email address.
  • The reason why you are requesting the take-down, such as copyright violation or privacy concerns.
  • A statement that you are the owner, or authorized to act on behalf of the owner, of an exclusive right that is allegedly infringed and that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.

Upon receipt of a request, LASD staff will:
  • Promptly acknowledge the request via email or other means of communication if you do not have an email account.
  • Assess the validity of the request.
  • Upon request, we may temporarily remove the material from public view while we assess the concern.
  • Upon completion of the assessment, we will take appropriate action and communicate that action to you.
